Terms of Service
Last updated: September 1, 2026
These Terms of Service (“Terms”) govern your use of firstcallops.ai and the voice intake services we provide. They are an agreement between you and FirstCallOps (“we”, “us”, “our”). We are based in the United States and serve customers in the United States.
If you use the site, request a demo, or otherwise deal with us as a visitor, these Terms apply to that use. If you become a customer, they also apply to the services, except where a signed order or services agreement says otherwise. In a conflict, the signed agreement controls.

1. The services
FirstCallOps provides managed voice intake. We answer designated inbound calls on a customer’s behalf, follow that customer’s intake questions and routing rules, capture the details their team needs, and send those details into the workflow they already use.
The services sit alongside a customer’s existing people and systems. They are not a law firm, a medical practice, a brokerage, or any other licensed professional service, and they do not replace the customer’s own team or professional judgment.
What we can connect to a customer’s systems is confirmed during scoping. We do not promise a particular integration unless it is written into the customer’s order.
2. Eligibility and accounts
The services are offered to businesses in the United States, not to consumers or to children under 13. If you accept these Terms on behalf of a company, you represent that you have authority to bind that company.
You are responsible for the accuracy of the information you give us and for activity under your account. Notify us promptly if you believe access has been compromised.
3. Call recording and AI disclosure
Every call we answer opens with an announcement that tells the caller two things: that the call is being recorded, and that they are speaking with an AI receptionist rather than a person. A caller who continues past that announcement has consented to the recording. A caller who would rather not be recorded can end the call.
Customers may adapt the wording of the greeting to suit their business. The recording and AI disclosures are always included and cannot be removed. Customers remain responsible for any further notice their own profession or industry requires.
We do not create voiceprints or any other biometric identifier from call recordings, and we do not use recordings to identify anyone by the sound of their voice. Recordings and transcripts are used to capture what was said and route the call.
Details of how we handle personal information, including recordings, are in our Privacy Policy.
4. Customer responsibilities
If you are a customer, you are responsible for:
- Providing accurate intake questions, routing rules, hours, and escalation contacts, and keeping them current.
- Reviewing captured details, summaries, and transcripts before you rely on them.
- Deciding how long recordings and related records are kept, and how they are used inside your business.
- Any professional, licensing, advertising, or industry rules that apply to your practice, including further notices to callers beyond the recording and AI disclosures we always include.
- How you handle information we pass to you, including client confidentiality obligations that belong to you rather than to us.
Callers are your callers. We act as your service provider when we answer them. We do not form an attorney-client, doctor-patient, or similar professional relationship with anyone who reaches your number, and nothing we capture is legal, medical, or other licensed advice.
5. Customer data
Recordings, transcripts, intake details, and other information we collect while answering calls for you (“Customer Data”) belong to you. We process Customer Data only on your instructions, to provide and improve the services, and as described in our Privacy Policy.
You grant us a limited license to host, transmit, transcribe, and otherwise process Customer Data as needed to operate the services.
You represent that you have the rights needed for us to process Customer Data in this way, including from callers where your business requires it.
6. Acceptable use
You may not, and may not allow others to:
- Use the services for outbound calling, SMS, or any purpose we have not agreed to in writing.
- Use the services to collect information from children under 13, or for unlawful, deceptive, harassing, or discriminatory activity.
- Probe, scan, or overload the site or the services, or attempt to bypass access controls.
- Reverse engineer the services except where applicable law allows it.
- Remove, obscure, or instruct us to omit the recording or AI disclosure on any call.
We may suspend the services if we reasonably believe they are being used in a way that creates legal, security, or operational risk.
7. AI limitations
The receptionist is an automated system. It follows the intake and routing rules you give us, but it can mishear, misunderstand, or omit details. It is not a substitute for a trained person, and it does not exercise professional judgment.
You should treat captured details as a starting point for your team, not as a complete or verified record, until someone on your side has reviewed them.
8. Fees
Fees, billing periods, and what is included in an engagement are set out in the customer’s order or services agreement. Unless that agreement says otherwise, fees are due as invoiced and are non-refundable for periods already provided.
Visiting the site or requesting a demo does not create a paid engagement.
9. Intellectual property
We retain all rights in the site, the services, our software, prompts, playbooks, and documentation. You retain all rights in your name, marks, intake content, and Customer Data.
You may not copy, resell, or create a competing service from our materials. We will not use your company name or logo in our marketing without your written permission.
10. Confidentiality
Each of us will protect the other’s non-public business information with at least reasonable care, and use it only to perform under these Terms. This does not apply to information that is public, independently developed, or rightfully received from someone else without a duty of confidentiality.
We may disclose confidential information if required by law, after giving notice where legally permitted.
11. Disclaimers
The site and the services are provided “as is.” We do not warrant that they will be uninterrupted, error-free, or that every call will be answered, transcribed, or routed without omission. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Telephony, carrier networks, and third-party systems we connect to are outside our control. We are not responsible for failures that originate there.
12. Limitation of liability
To the fullest extent permitted by law, neither of us is liable to the other for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, even if advised that they were possible.
Our total liability arising out of these Terms or the services is limited to the fees you paid us for the services in the twelve months before the claim. If you have not paid fees, our total liability is limited to one hundred dollars.
These limits do not apply to a party’s fraud, or to your payment obligations, or to your indemnity in section 13, in each case only to the extent applicable law does not allow the limit.
13. Indemnity
You will defend and indemnify us against claims, damages, and reasonable legal fees arising from: (a) Customer Data; (b) your intake rules, greetings, or instructions; (c) your use of the services in violation of these Terms or of law; or (d) a claim that your handling of a caller violated a professional, privacy, or recording rule that was yours to satisfy.
We will defend and indemnify you against claims that the unmodified services, as we provide them, infringe a third party’s U.S. intellectual property right, except to the extent the claim arises from your instructions, Customer Data, or a combination with something we did not supply.
14. Term and termination
These Terms remain in effect while you use the site or the services. Either of us may terminate a paid engagement as the order or services agreement provides. We may also terminate or suspend the services immediately if you materially breach these Terms and do not cure the breach within thirty days after notice, or immediately if the breach cannot reasonably be cured.
After termination we will make Customer Data available to you for a reasonable period, then delete or return it according to your instructions and our Privacy Policy, except where we must retain a copy for legal reasons.
Sections that by their nature should survive termination do so, including sections 5, 9 through 13, 15, and 16.
15. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. The state and federal courts in Cook County, Illinois, have exclusive jurisdiction, and each of us consents to those courts.
If a court finds any part of these Terms unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
16. Changes
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date above. If a change materially affects a paying customer, we will give reasonable notice. Continued use of the site or the services after the updated Terms take effect constitutes acceptance, except where a signed agreement requires a different process.
